Terms & Conditions

Effective date: August 17, 2026. These Terms & Conditions govern your use of the PhocusKam Photography website and any photography, branding, headshot, event, gallery, quote, invoice, digital delivery, print, or related services offered by PhocusKam Photography.

By using this website, submitting an inquiry, booking a session, accessing a client gallery, approving a quote, or purchasing services or products, you agree to these Terms. If you sign a separate written agreement with PhocusKam Photography, that agreement controls if it conflicts with these Terms.

PhocusKam Photography provides professional photography services, including personal branding sessions, headshots, event photography, visibility-focused content creation, client proof galleries, final image delivery, and related products or services.

Service details, deliverables, fees, timelines, usage rights, and cancellation terms may vary by proposal, invoice, booking page, or signed agreement.

• Session dates are not guaranteed until required booking steps are completed, including any required deposit, retainer, payment, signed agreement, or written confirmation.
• Fees, balances, due dates, taxes, payment schedules, and accepted payment methods will be stated in your quote, invoice, checkout, booking confirmation, or signed agreement.
• Failed, disputed, reversed, or late payments may delay booking confirmation, gallery delivery, final image delivery, product fulfillment, or other services.

• Please submit rescheduling requests as early as possible.
• Cancellation, rescheduling, late arrival, no-show, weather, event access, or location-related terms are governed by your signed agreement or written confirmation.
• If no separate written term applies, PhocusKam Photography may determine reasonable next steps based on scheduling availability, work already performed, and project-specific circumstances.

• Photography timelines depend on project scope, client responsiveness, event timing, editing volume, seasonal workload, and technical factors.
• Proof galleries are typically delivered within the timeframe stated for the selected service, and final edited images are delivered after required selections and approvals are completed.
• Raw or unedited files are not included unless expressly agreed in writing.

PhocusKam Photography retains copyright in all images unless a written agreement expressly transfers copyright.

• Clients receive a limited license to use delivered final images for the purposes stated in the applicable agreement, invoice, or written confirmation.
• Images may not be sold, sublicensed, heavily altered, used in misleading contexts, submitted to third-party commercial licensing platforms, or used beyond the agreed scope without written permission.

Client proof galleries and final galleries may be delivered through private online access links. Gallery links, passwords, access tokens, and download permissions are intended only for authorized recipients.

• You are responsible for keeping private gallery access information confidential.
• Proof images may be watermarked or download-restricted unless downloads are expressly enabled.

• You are responsible for obtaining any required permissions, releases, venue approvals, permits, props, wardrobe, brand assets, product samples, guest approvals, or third-party consents unless PhocusKam Photography agrees otherwise in writing.
• If minors are photographed, a parent or legal guardian must provide any required consent.

Portfolio, website, social media, advertising, educational, editorial, or promotional use of images by PhocusKam Photography will follow the signed agreement or written project terms.

If you need confidentiality, restricted publication, delayed publication, or non-use of images, that requirement must be agreed in writing before or at booking.

• If prints, products, merchandise, shipping, or third-party fulfillment options are offered, availability, pricing, tax, shipping timelines, color rendering, and fulfillment may depend on third-party providers.
• Screen colors and printed colors may vary.
• Third-party payment, scheduling, email, hosting, storage, fulfillment, and gallery providers may have their own terms and policies.

Except where prohibited by law, PhocusKam Photography liability is limited to the amount paid for the specific service or product giving rise to the claim.

PhocusKam Photography is not responsible for indirect, incidental, consequential, lost profit, reputational, platform outage, third-party service, venue restriction, weather, emergency, or force majeure damages.

These Terms are governed by the laws of the State of New York unless a signed agreement says otherwise.
